Interpretation and Definitions

Interpretation

The words whose initial letters are capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of this Privacy Policy:

  • Account means a unique account created for You to access Our Service or parts of Our Service.
  • Affiliate means an entity that controls, is controlled by, or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.

  • Cookies are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website, among its many uses.
  • Country/State refers to: Sri Lanka.
  • Device means any device that can access the Service, such as a computer, a cell phone or a digital tablet.
  • Personal Data (or “Personal Information”) is any information that relates to an identified or identifiable individual. We use “Personal Data” and “Personal Information” interchangeably unless a law uses a specific term.
  • Sale and Sharing, for purposes of the California section below, have the meanings given to them under the CCPA/CPRA, which can include disclosing Personal Information to a third party (such as an advertising partner) in exchange for monetary or other valuable consideration, including for cross-context behavioral advertising.
  • Service refers to the Website.
  • Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service, to process payments, or to assist the Company in analyzing how the Service is used.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • User means any individual who accesses or uses the Service.

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:

Usage Data

Usage Data is collected automatically when using the Service.

Advertising, Analytics & Remarketing

We work with third-party advertising and analytics companies to show You ads on the Website and to serve remarketing advertising to You on other websites and platforms, based on Your prior visits to Our Website. These partners may use cookies, web beacons, and similar technologies to collect information about Your browsing activities over time and across different websites in order to provide targeted advertisements.

These third parties may include (among others) Google (Google Analytics, Google Ads), and social media advertising platforms such as Meta (Facebook/Instagram) Ads. Information collected by these partners is subject to their own privacy policies, not this one.

You have choices about the collection and use of Your information for advertising purposes:

Please note that opting out of interest-based advertising does not mean You will no longer see ads; it means the ads You see may be less relevant to You.

Payments and Purchases

If You purchase a product or service through the Service, We (or Our payment processor, acting as a Service Provider) will collect the payment information necessary to process the transaction, such as Your name, billing address, and payment card or other payment method details. Payment card information is generally processed directly by Our third-party payment processor and is handled in accordance with applicable payment card industry security standards; We do not store full payment card numbers on Our own servers.

We use payment and order information to process transactions, prevent fraud, provide order confirmations and support, and comply with tax, accounting, and other legal obligations.

Email Communications and Marketing

If You provide Us with Your email address (for example, by creating an Account, making a purchase, or signing up for updates), We may send You transactional emails (such as order confirmations and account notices) and, where You have consented or as otherwise permitted by applicable law, marketing emails about products, promotions, and offers that may interest You.

You may opt out of marketing emails at any time by clicking the “unsubscribe” link included in every marketing email We send, or by contacting Us at the email address listed in Contact Us. Please note that You may continue to receive transactional or account-related emails even after opting out of marketing communications, where necessary for the operation of the Service.

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with Our legal obligations (for example, if We are required to retain Your data to comply with applicable laws, including tax and accounting laws related to purchases made through the Service), resolve disputes, and enforce Our legal agreements and policies.

Where possible, We apply shorter retention periods and/or reduce identifiability by deleting, aggregating, or anonymizing data. Unless otherwise stated, the retention periods below are maximum periods (“up to”) and We may delete or anonymize data sooner when it is no longer needed for the relevant purpose.

  • Account Information — User Accounts: retained for the duration of Your Account relationship plus up to 24 months after account closure to handle any post-termination issues or resolve disputes.
  • Order and Payment Data — retained for as long as required to comply with tax, accounting, and consumer protection laws (typically up to 7 years), after which it is deleted or anonymized.
  • Customer Support Data — support tickets, correspondence, and chat transcripts: up to 24 months from the date of ticket closure, for follow-up inquiries, service quality, staff training, and defending against potential legal claims.
  • Usage and Advertising Data — website analytics data, advertising identifiers, and server logs: up to 24 months from the date of collection, or as governed by the relevant third-party advertising or analytics provider’s own retention practices.

We may retain Personal Data beyond the periods stated above where required by legal obligation, to establish or defend legal claims, at Your explicit request, or because data exists in backup systems scheduled for routine deletion. You may request information about how long We will retain Your Personal Data by contacting Us.

Transfer of Your Personal Data

Your information, including Personal Data, is processed at the Company’s operating offices in Sri Lanka and in any other places where the parties involved in the processing (including Our Service Providers, advertising partners, and payment processors) are located. This means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those of Your jurisdiction.

Where required by applicable law, We will ensure that international transfers of Your Personal Data are subject to appropriate safeguards and, where relevant, supplementary measures (such as Standard Contractual Clauses for transfers from the EEA/UK). No transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place, including the security of Your data.

Delete Your Personal Data

You have the right to delete or request that We assist in deleting the Personal Data that We have collected about You. Our Service may give You the ability to delete certain information about You from within the Service, such as through Your Account settings.

Please note that We may need to retain certain information when We have a legal obligation or lawful basis to do so (for example, transaction records required for tax purposes).

Disclosure of Your Personal Data

Business Transactions

If the Company is involved in a merger, acquisition, or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

Law Enforcement

Under certain circumstances, the Company may disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

Security of Your Personal Data

Children’s and Minors’ Privacy

The Service is not directed to, and We do not knowingly collect Personal Information from, anyone under the age of 16. We also do not knowingly sell or share (as those terms are used under the CCPA/CPRA) the Personal Information of individuals under the age of 16.

If We become aware that We have collected Personal Information from anyone under the age of 16, We will take steps to remove that information from Our servers as soon as reasonably possible.

Some countries and states set a higher age at which an individual can consent to the processing of their own Personal Information. Where We rely on consent as a legal basis and the law applicable to a User sets an age higher than 16, We may require the consent of that User’s parent or guardian before We collect and use their Personal Information.

Your Rights Under GDPR (EEA / UK Users)

Your Rights Under CCPA/CPRA (California Residents)

If You are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA), gives You certain rights regarding Your Personal Information.

Categories of Personal Information We Collect

In the preceding 12 months, We may have collected the following categories of Personal Information, as defined by the CCPA/CPRA: identifiers (such as name, email address, IP address); commercial information (such as purchase history); internet or other electronic network activity information (such as browsing and Usage Data); geolocation data (approximate, derived from IP address); and, if You provide it, payment information. We do not knowingly collect sensitive Personal Information beyond what is necessary to process a payment.

Sale / Sharing of Personal Information

We do not sell Personal Information for money. However, Our use of advertising and remarketing cookies and similar technologies (described in Advertising, Analytics & Remarketing) may be considered a “sale” or “sharing” of Personal Information under the CCPA/CPRA’s broad definitions, because it involves disclosing certain identifiers and online activity to advertising partners for cross-context behavioral advertising.

CalOPPA Disclosures

Consistent with the California Online Privacy Protection Act (CalOPPA):

  • Users of Our Service may visit anonymously; however, certain features (such as purchasing a product) require providing identifying information.
  • Once this Privacy Policy is posted, changes to it will be reflected on this page with an updated “Last updated” date, and, where required, We will notify You by email or a prominent notice on Our Service, as described in Changes to this Privacy Policy.

  • Third parties, including analytics and advertising partners described above, may collect Personal Information about Your online activities over time and across different websites when You use Our Service.
